26th Circuit Court judge John Kowalski has dismissed a lawsuit brought against the City of Alpena by it's former City Manager.Hired in February 2006, Former Alpena City Manager Michael Uskiewicz filed suit against the city after leaving in December of that year, saying there was a difference in management philosophy. His severance contract became the issue, with a claim of the city owing him over 36 thousand dollars, along with unused sick and vacation time. The city argument... there was a clerical error, and the city countersued in an effort to reform the severance agreement to reflect the intention of the parties at the time the council accepted the resignation from Uskiewicz. In reviewing the merits of the filings, Kowalski met with both sides privately, but no agreement was reached. Afterwards, he issued his opinion that the city had proven by clear and convincing evidence the severance agreement should be reformed. |
